ADDITIONAL TERMS FOR SPOND GROUP ADMINISTRATORS (“ADMINISTRATOR TERMS”)

Introduction and scope

Spond Team streamlines administrative tasks, facilitates efficient communication, and enhances member management in teams and other groups, including through integrations with Spond Club. Groups in Spond Team (“Spond Groups”) are administered by one or more persons having administrative tasks, rights and obligations within the groups (“Administrators”). Each Administrator plays an important role in keeping Spond a user-friendly and secure environment for all users. 

These Administrator Terms apply (in addition to the Spond Terms of Use) if you are an Administrator in a Spond Group. Note that Spond Groups may have different permission levels for Administrators, and that this may affect the extent of your obligations as an Administrator as described below. Note also that you may become an Administrator (on behalf of the relevant club) if a Spond Group is imported to or created within Spond Club.  

Data controllership

Controllership of the Administrator

As an Administrator you are a data controller in terms of the GDPR with a particular responsibility to:

  • Have consent from those you wish to add as members in a Spond Group or participants in a Spond Fundraiser. If persons you add are under 13 years old you need consent from their legal guardians.
  • Ensure that you have an appropriate legal basis if you wish to process Spond Group members personal data for purposes outside Spond, such as in connection with export of statistics, attendance, etc. 
  • If you intend to publish, encourage or otherwise accommodate for the storing or sharing of sensitive information about your Spond Group members or others, you must ensure that the affected persons have accepted such use of their data.

Joint controllership

Certain functionality and corresponding processing activities within a Spond Group entail a joint controllership, as defined in article 26 of the GDPR, between you as an Administrator and Spond AS. This includes processing such as:

  1. When the Administrator and Spond invites members and non-members to join a Spond Group;
  2. When a club using Spond Club imports a Spond Group from Spond Team to Spond Club; 
  3. The customization of member profiles within a Spond Group; and
  4. Other processing activities where Spond and the Administrator jointly determine the purpose and means 

Item I to IV are collectively referred to as the “Joint Purposes”.

Spond is responsible for compliance with all relevant obligations under the GDPR concerning the Joint Purposes, including the provisions outlined in Articles 12-22 and Articles 32-34 of the GDPR. This commitment means that Spond will inform Spond Group members about the data being processed in relation to the Joint Purposes, implement appropriate technical and organisational measures to protect personal data and support their right to access of personal data and deletion. Spond retains the sole discretion to decide how to comply with these obligations.

If you receive communication from a member of your group regarding the Joint Purposes or other request you receive regarding privacy, it is your responsibility to promptly inform Spond at [email protected]. This notification should be made immediately and, in any case, within three working days.

Spond will answer the request in accordance with our obligations under the GDPR and other applicable law. You agree to collaborate with Spond, including by providing timely and required assistance in connection with responses to such requests.
