Spond Competition Entry Terms

1. The promoter of Spond prize draws (including “Spond Superdraw”), competitions and promotions (“Spond Competitions”) to which these terms and conditions apply is Spond Ltd, a company registered in England & Wales with registered address at Profile West Suite 2, First Floor, 950 Great West Road, Brentford, Middlesex, TW8 9ES and company number 13705044 (“Spond” or “we”).

2. Sporting groups and other organisations (“Participating Groups”) use the Spond service as a way of raising money for their Participating Group by marketing entries in Spond Competitions.

3. Each person who participates in a Spond Competition (“entrant” or “you”) is bound by these terms and conditions (“Entry Terms”), along with the entry instructions and specific rules corresponding to that Spond Competition and which are presented online (“Specific Rules”).

4. Except where the applicable Specific Rules specify otherwise:

a) entrants must be residents of Great Britain, excluding employees of Spond, their families, agents or any third party directly associated with administration of the Spond Competition.

b) you must be aged 18 or over to enter.

5. If the Spond Competition is a prize draw (such as “Spond Superdraw”), it can be entered by online purchase OR free of charge in the manner described below. All prize draw entries must be submitted:

a) for online purchases, via www.spond.com or through the Spond app by supplying details required on the applicable prize draw entry page(s) and completing payment of the applicable VAT inclusive entry fee (you may purchase up to the maximum number of entries specified on the prize draw entry page(s), otherwise as many as you wish); OR

b) by post, addressed to Spond Ltd, Festival House, Jessop Ave, Cheltenham, GL50 3SH, for free entry (limited to one postal entry per person). To be considered valid, postal entrants must mail their full name and address and a contact telephone number along with the email address (handwritten and printed in legible English, identifying the relevant prize draw by its specified closing date and the relevant Participating Group) on an unenclosed postcard with a first or second class stamp. Entries not received on a postcard as described, will not be considered. Each conforming postal entry qualifies as a single entry in the relevant Spond Competition.

6. The opening date and closing date for entries is specified in the relevant Specific Rules applicable to the Spond Competition you are participating in. Entries received after the specified time and date for closing will not be entered into the corresponding Spond Competition.

7. If for any reason a technical interruption, fault or site failure occurs when purchasing an entry online, we are not responsible for incomplete purchases and any incomplete purchases will not be considered valid for entry. Spond accepts no responsibility for any purchases not completed or received for any reason. To avoid doubt, this includes postal entries that are mislaid, delayed or damaged in the postal service.

8. The number of winners and the applicable prize(s) are specified in the Specific Rules.

9. Prize draw winner(s) will be chosen by random draw performed by a computer process on the draw date and time specified in the Specific Rules (“Draw Date”).

10. Prize draw winner(s) will be notified by email and/or telephone (using details provided at entry) on the Draw Date and must provide a postal address in UK and UK bank account details to claim their prize. If a winner does not respond within three days of being notified by Spond, then the winner’s prize will be forfeited and we will be entitled to select another winner in accordance with the process described above.

11. Cash prizes will be sent to the winners by electronic bank transfer within approximately 14 days of being notified of their win. Prizes of goods or services may take longer. It is the winner’s responsibility to pay any and all applicable taxes on prizes.

12. For prizes other than cash, we reserve the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond our control makes it necessary to do so.

13. Spond must either publish or make available information that indicates that a valid award took place. If Spond chooses not to publish, we will send the surname and county of the prize winners and, if applicable copies of their winning entries, to anyone who contacts support on our contact page or writes to Spond Ltd at Festival House, Jessop Avenue, Cheltenham, Gloucestershire, GL50 3SH (enclosing a self-addressed envelope) within one month after the specified closing date.

14. If you object to any or all of your surname, county and, if applicable, winning entry being published or made available, please contact support on our contact page. In such circumstances, Spond must still provide the information and winning entry to the Advertising Standards Authority on request.

15. Spond may request winning entrants participate in publicity.

16. Personal data supplied during the course of this promotion will be processed to operate the Spond Competition you are taking part in, and as set out in our Privacy Policy located at https://www.spond.com/privacy-policy/

17. Unless the Specific Rules provide otherwise, Spond supplies the prizes. Prizes are non-exchangeable and non-transferable.

18. Spond’s decision regarding any aspect of a Spond Competition is final and binding and no correspondence will be entered into. Prizes are awarded at our discretion and no prizes will be awarded as a result of improper actions by or on behalf of an entrant.

19. Entrants must ensure that all information provided to Spond directly or indirectly is accurate, true, current and complete. We reserve the right to refuse entry, or refuse to award the prize to anyone in breach of these terms and conditions.

20. Spond reserves the right to verify your eligibility and to check your identity. If you have been asked for proof of your identity and/or your eligibility, your failure to provide such proof within a reasonable time could result in your disqualification from a competition or the withdrawal of any prize.

21. Spond reserves the right to disqualify entrants if their conduct is contrary to the spirit or intention of the prize draw entered. We may declare an entry void (without refund being given) if the entrant engages in any form of fraud whatsoever or any hacking or interference with the proper functioning of the website or the Spond app (including, for example, automated bulk entries).

22. If a winning entrant is disqualified from a competition, it will be at Spond’s discretion to decide whether a replacement will be selected. If we decide to select a replacement, the replacement will be chosen using the same selection procedure as the original entrant and will be subject to these Entry Terms.

23. Your statutory rights are not affected. However, so far as permitted by law:

a) Spond, its agents or distributors will not in any circumstances be responsible or liable to compensate any winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of Spond, its agents or distributors or that of their employees; and

b) if Spond fails to comply with these terms and conditions, it will be responsible for loss or damage an entrant suffers that is a foreseeable result of that breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable or that is caused by a breach by the Participating Group, the Participating Group’s representative, or a third party over which Spond has no direct control. Loss or damage is foreseeable if it was an obvious consequence of Spond’s breach or if it was contemplated by the entrant and Spond at the time that the entrant entered the prize draw.

24. Spond will take all reasonable steps to ensure the service functions correctly, but does not guarantee that the service will be continuous, uninterrupted or error free and will not be responsible for any losses caused by errors or disruptions to the service.

25. We reserve the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so (e.g. suspected technical error or interference).

26. These Entry Terms form a legal agreement between you and Spond in respect of the relevant Spond Competition you enter.

27. Each Spond Competition will be governed by the laws of England and Wales. The courts of Great Britain shall have exclusive jurisdiction to deal with disputes arising out of this agreement.

28. Entrants should notify Spond of any issues or complaints in relation to the Service by sending details of the issue or complaint to the support team on our contact page. Spond will endeavour to solve any issues notified to it in a fair and reasonable manner. If the issue is not resolved within 21 days it will be referred to the Customer Success Manager at Spond who will investigate the complaint in good faith and take any action that is deemed necessary. The Customer Success Manager may request any further information or evidence that may be required in order to investigate the issue. Please note this email is not a valid entry route.

29. Please be sure to read these Entry Terms carefully even if you have previously entered a Spond Competition, as they are subject to change. Any change we make to these Entry Terms will not take effect in respect of an individual Spond Competition that you are currently participating in. If however you subscribe to Spond Competitions, we will notify you of the amendments in advance so that you will have at least 14 days to decide whether to continue your subscription before the change takes effect.
