These Terms of Service (“Terms”) govern the use of Spond AS’ (“Spond”) club solution, Spond Club (“Service”). A detailed description of the Service can be found at spond.com.
By registering the organisation as a user of the Service on Spond’s website and accepting these Terms, an agreement is entered into. The registered organisation is hereinafter referred to as “the Club.” The person registering the Club and accepting the Terms confirms they have the authority to enter into agreements on behalf of the Club.
The Club must designate a contact person (“the Contact Person”). Any change in the Contact Person must be notified to Spond in a timely manner (see contact details at the end of the Terms).
The Contact Person will receive a code to access the Service and may then delegate access to other individuals associated with the Club. The Club must ensure that all users of the Service have read and understood their responsibilities under the Terms.
The Contact Person and all other users must also accept Spond’s general terms of use. If any member of the Club uses the Service in violation of the Terms, the Club must revoke their access. If the Club fails to do so, Spond may revoke access and terminate the agreement with immediate effect. Spond may also remove or censor content that violates these Terms or the purpose and intent of the Service.
The Service will be continuously updated, with functionality added or removed. If changes are expected to have significant negative consequences for the Club, we will notify the Contact Person directly or via spond.com.
Spond may amend the Terms. In the event of substantial changes, Spond will notify the Contact Person appropriately. Minor changes will be published on spond.com, and the Club is encouraged to check spond.com regularly.
Spond strives to ensure the security of the Service but cannot guarantee protection against viruses, cyber-attacks, or similar threats.
Spond processes personal data related to members and other individuals associated with the Club on behalf of the Club. A data processing agreement between the Club and Spond outlines Spond’s obligations regarding personal data processing.

The Club agrees to use the Service in compliance with these Terms and only for the intended purpose. This means that neither the Club nor its representatives shall:
The Service is generally available 24/7. However, it may be temporarily unavailable due to maintenance, updates, or other reasons. Spond will notify users of planned downtime when possible via the website. If the Service becomes unavailable or issues arise, the Contact Person or users can contact Spond’s Help Centre for support.
Spond holds all intellectual property rights, including copyright and trademarks, related to the Service and content created by or for Spond. The Club retains ownership of its own content. Content published by other clubs or users remains their property, and the Club may not use it without permission.
The Club is responsible for the content it publishes on the Service. Any content that infringes third-party rights will be removed as soon as Spond becomes aware of it.
Spond may contact the Club and users of the Service to provide marketing information and updates about new features or services.
The Service allows the Club to issue and manage payments, such as membership fees and training charges. Use of these payment features incurs transaction fees. If the Club collects membership fees that must be reported to the Norwegian Sports Federation (NIF), an additional cost per member applies.
The Club is responsible for correctly marking (ticking) membership fees for NIF reporting. If this is not done correctly, Spond will adjust this in consultation with the Club and charge the applicable fee per member, plus an administrative fee of NOK 10,000.
Costs are outlined on the website and will be clearly communicated before they are incurred. Significant pricing model changes will be announced in advance.
The Club may use the Service to issue refunds to members and others. Refunds can be initiated by authorised individuals within the Club. The Club is responsible for managing refunds.
The Club’s account within the Service (provided by Stripe) allows for overdrafts up to:
This credit facility (“Refund Credit”) enables the Club to issue refunds even when the account balance is negative. The Club may apply to increase the Refund Credit. Any interest incurred on the account is the responsibility of the Club. Spond provides security to Stripe for the Refund Credit amount in use. If a negative balance persists for more than three months, Spond will invoice the Club for the outstanding amount.
Spond is not liable for financial losses or costs incurred by the Club, including but not limited to errors, unavailability, or data loss.
Any liability does not extend to indirect losses suffered by the other party.
These Terms apply until either party terminates the agreement.
Spond may terminate the agreement with one month’s written notice. The Club must secure any data it wishes to retain before the termination period ends, after which Spond will delete the Club’s account and all related data.
The Club may terminate the agreement immediately or at a specified future date. Before termination, the Club must secure any data it wishes to retain. After termination, Spond will delete the Club’s account and all related data.
If the Club breaches the Terms, Spond may terminate the agreement immediately or suspend access.
Any disputes between the Club and Spond shall be governed by Norwegian law. Disputes that cannot be resolved amicably shall be settled in the Oslo District Court.
